1. Introduction
These Affiliate Program Terms and Conditions ("Agreement") constitute a legally binding agreement between you ("Affiliate") and SIA "Cosmetics NORD", registration number 40103277805, address: Lielmaņi, Mārupes pag., Mārupes nov., Latvia, LV-2167, operating the Selfnamed platform at www.selfnamed.com ("Selfnamed", "we", "us", "our").
By submitting an application to join the Selfnamed Affiliate Program, you confirm that you have read, understood, and agree to be legally bound by this Agreement. If you are an individual, you confirm that you are at least 18 years of age. If you are applying on behalf of a legal entity, you confirm that you are authorised to act on that entity’s behalf. If you do not agree to these terms, do not apply to or participate in the Affiliate Program.
2. About Selfnamed
Selfnamed is a private label skincare platform operated by SIA "Cosmetics NORD" that enables businesses to create and sell custom-branded cosmetics products. The Affiliate Program allows approved third parties to refer new customers to Selfnamed and earn commission on qualifying orders.
3. Application and Approval
3.1. To apply for the Affiliate Program, you must complete and submit the official application form provided by Selfnamed.
3.2. All applications are reviewed manually. Submission of an application does not guarantee acceptance. Selfnamed reserves the right to approve or reject any application at its sole discretion, without obligation to provide a reason.
3.3. Upon approval, the Affiliate will be issued a unique promotional code and a unique referral link. This Agreement enters into force upon issuance of the promotional code and referral link.
3.4. Selfnamed may re-evaluate any approved Affiliate at any time and may revoke participation if the Affiliate is found to be in breach of this Agreement or if their activities are deemed harmful to Selfnamed’s reputation or business.
4. Promotional Code and Referral Link
4.1. Each Affiliate receives one unique promotional code and one unique referral link upon approval. Both are personal and non-transferable.
4.2. Promotional codes and referral links do not have a fixed expiration date. However, Selfnamed reserves the right to deactivate or terminate any promotional code or referral link at its discretion and at any time.
4.3. A customer becomes associated with the Affiliate from the moment they either (i) place an order using the Affiliate’s promotional code, or (ii) click the Affiliate’s unique referral link, provided they place a qualifying order within 90 (ninety) days of that click, tracked via a cookie set at the time of the click. Where a customer is attributed to more than one Affiliate — for example, having clicked one Affiliate’s referral link before placing an order using a different Affiliate’s promotional code — the most recent link click with an active tracking cookie shall take precedence. Once this association is established, the Affiliate earns commission on all subsequent orders placed by that customer — including orders made without the promotional code or referral link — for a period of 6 (six) months from the date of the first qualifying order. After this 6-month period, no further commission is earned on that customer’s orders unless the customer places a new qualifying order via the Affiliate’s promotional code or referral link, which restarts the 6-month period.
4.4. The Affiliate Program applies exclusively to newly registered customers. A customer is considered “new” if they registered on the Selfnamed platform after the date the Affiliate’s promotional code or referral link was issued and had not previously made any purchase on the platform. The following scenario applies:
(a) If the customer’s first order is placed using the Affiliate’s promotional code, the customer is immediately associated with the Affiliate and the 6-month commission period begins from that first order.
4.5. The Affiliate must not share, sell, or distribute their promotional code or referral link in any way that could constitute fraud, abuse, or misrepresentation of the Affiliate Program.
5. Commission
5.1. The Affiliate earns a commission of 10% of the qualifying order value placed by referred customers using the Affiliate’s promotional code or referral link.
5.2. Commission is calculated on the amount actually paid by the customer for the products, excluding shipping, taxes and duties. Where a discount has been applied other than the Affiliate’s own referral discount, commission is calculated on the discounted amount actually paid. For a referred customer’s first order, where the Affiliate’s referral discount has been applied, commission is calculated on the pre-discount order value.
Example:
A customer places an order with a product value of EUR 1,000 (or USD equivalent) after a 5% bulk discount has been applied. The Affiliate’s commission is 10% of EUR 1,000 = EUR 100.
5.3. Commission is capped at EUR 2,500 (or USD equivalent) per referred customer per calendar month, regardless of the total order value placed by that customer in that month.
Example:
A referred customer places orders totalling EUR 30,000 in one calendar month. The calculated commission would be EUR 3,000, but the cap limits the Affiliate’s commission for that customer in that month to EUR 2,500.
5.4. There is no cap on the number of customers an Affiliate may refer, and the monthly cap applies per customer individually.
5.5. Commission is earned once the order has been fully shipped. No commission is credited until the entire order has been dispatched. If an order is cancelled, returned, or refunded for any reason, the corresponding commission will not be paid or will be deducted from accrued earnings. If a refund occurs after the commission has already been paid out to the Affiliate, Selfnamed reserves the right to deduct the corresponding amount from future commission payments.
6. Commission Tracking and Reporting
6.1. Commission tracking is managed via third-party affiliate tracking software. This software is used to record link clicks, tracking cookies, and promotional code redemptions for the purpose of attributing referred customers to Affiliates.
6.2. The Affiliate can view their accrued commissions at any time via their dashboard on Selfnamed's third-party affiliate tracking platform. The Affiliate may also contact Selfnamed at affiliates@selfnamed.com with any questions regarding their commissions.
7. Payments
7.1. All commission payments are made via PayPal, on a monthly schedule.
7.2. The minimum payout amount is EUR 50 (or USD equivalent). Balances below this threshold will carry over to the following month until the threshold is met.
7.3. In order to receive payment, the Affiliate must provide and maintain a valid PayPal account. Selfnamed is not responsible for delays or failed payments resulting from incorrect, outdated, or invalid PayPal account details.
7.4. The Affiliate is solely responsible for compliance with applicable tax obligations in their jurisdiction relating to commissions received. Selfnamed is not responsible for tax filing or reporting on behalf of the Affiliate.
7.5. Selfnamed reserves the right to withhold payment if there is reasonable suspicion of fraud, breach of this Agreement, or if any dispute is pending.
7.6. Any accrued but unclaimed commissions that remain unpaid for a period of 12 (twelve) months or more due to a missing, invalid, or inaccessible PayPal account may, at Selfnamed's sole discretion, be voided and removed from the Affiliate's balance.
8. Affiliate Obligations
8.1. The Affiliate agrees to promote Selfnamed honestly and accurately, and not to make false, misleading, or exaggerated claims about Selfnamed’s products or services.
8.2. The Affiliate must clearly disclose their affiliate relationship with Selfnamed wherever required by applicable law or platform guidelines.
8.3. The Affiliate must not engage in spamming, unsolicited email campaigns, or any deceptive advertising practices.
8.4. The Affiliate must not bid on "Selfnamed" or any variations or misspellings thereof as keywords in paid search (PPC) advertising campaigns.
8.5. The Affiliate must not create social media accounts, pages, or groups that impersonate or could be mistaken for official Selfnamed channels.
8.6. The Affiliate must not use Selfnamed’s logos, trademarks, or brand assets in any way that has not been expressly authorized in writing by Selfnamed.
8.7. The Affiliate is an independent contractor. Nothing in this Agreement creates a partnership, joint venture, employment, or agency relationship between the Affiliate and Selfnamed.
8.8. The Affiliate grants Selfnamed a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display any content created by the Affiliate that features or promotes Selfnamed (including but not limited to photos, videos, reviews, and social media posts) for Selfnamed’s own marketing and promotional purposes, across any channel. Upon request, the Affiliate agrees to provide Selfnamed with copies of such content in a suitable format. This licence survives termination of this Agreement with respect to content already created and shared prior to termination.
9. Prohibited Affiliates
9.1. Selfnamed does not accept applications from, and may terminate the participation of, Affiliates whose primary activity is operating coupon, cashback, or deal-aggregation websites or platforms. This includes Affiliates who list, post, or otherwise distribute their promotional code or referral link on any third-party coupon, cashback, or deal-aggregation website or platform, regardless of whether they operate that site themselves.
9.2. Selfnamed reserves the right to reject or terminate any Affiliate whose activities promote content that is illegal, harmful, discriminatory, or otherwise objectionable at Selfnamed’s sole discretion.
9.3. Self-referrals are strictly prohibited. An Affiliate may not refer themselves, their own business, or any account over which they have direct or indirect control, and will not receive commission on such referrals.
9.4. The Affiliate confirms that they are not subject to trade, financial, or economic sanctions, and do not appear on any sanctions-related list maintained by the European Union, the United Nations, or any other applicable authority. The Affiliate must not promote Selfnamed in or refer customers from any country or territory subject to comprehensive sanctions or embargoes.
10. Intellectual Property
10.1. Selfnamed grants the Affiliate a limited, non-exclusive, non-transferable, revocable licence to use Selfnamed’s name and approved marketing materials solely for the purpose of promoting the Affiliate Program in accordance with this Agreement.
10.2. The Affiliate must not alter, modify, or use Selfnamed’s intellectual property in any way that is misleading, disparaging, or inconsistent with Selfnamed’s brand guidelines.
11. Termination
11.1. Either party may terminate this Agreement at any time by providing written notice to the other party.
11.2. Selfnamed may terminate this Agreement immediately and without notice in the event of fraud, material breach, or any activity deemed harmful to Selfnamed.
11.3. Upon termination, the Affiliate’s promotional code and referral link will be deactivated. Any commissions accrued on valid orders prior to termination will be paid, provided the Affiliate has met all conditions for payment. Commissions will not be paid if the account is terminated due to fraud or material breach.
12. Modifications
Selfnamed reserves the right to modify these Terms and Conditions at any time. Changes will be communicated to active Affiliates via email. Continued participation in the Affiliate Program after the effective date of any changes constitutes acceptance of the updated terms.
13. Limitation of Liability
13.1. Selfnamed’s total liability to the Affiliate under this Agreement shall not exceed the total commissions paid to the Affiliate in the three (3) months preceding the event giving rise to the claim.
13.2. Selfnamed shall not be liable for any indirect, incidental, or consequential damages, including loss of profits or revenue, arising out of or in connection with this Agreement.
14. Indemnification
The Affiliate agrees to indemnify, defend, and hold harmless SIA "Cosmetics NORD", its subsidiaries, officers, employees, and partners against any claims, damages, losses, and expenses (including legal fees) arising from: (i) the Affiliate’s breach of this Agreement; (ii) the Affiliate’s promotional activities; or (iii) any misrepresentation made by the Affiliate regarding Selfnamed or its products.
15. Confidentiality
Any confidential or proprietary information disclosed by either party in connection with this Agreement shall be kept strictly confidential and not disclosed to any third party without prior written consent, unless required by law.
16. Governing Law and Dispute Resolution
16.1. This Agreement shall be governed by and construed in accordance with the laws of the Republic of Latvia.
16.2. Any disputes arising out of or in connection with this Agreement shall first be attempted to be resolved by negotiation. If no resolution is reached, disputes shall be submitted to the competent courts of Latvia.
17. Miscellaneous
17.1. This Agreement constitutes the entire agreement between the parties regarding the Affiliate Program and supersedes all prior communications or agreements.
17.2. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
17.3. The Affiliate may not assign or transfer any rights or obligations under this Agreement without prior written consent from Selfnamed.
17.4. Selfnamed’s failure to enforce any right or provision of this Agreement shall not constitute a waiver of that right or provision.
